TERMS AND CONDITIONS OF SALE

These terms and conditions (hereinafter the “Terms and Conditions”) apply to transactions between ANAIS C. and any consumer (hereinafter “you”) placing an order on the website www.anaisc.com (hereinafter the “Website”).

Sales on the Site are intended exclusively for consumers purchasing items for their personal use, and are not intended for resale.

The Terms and Conditions may be modified at any time. The applicable version of the Terms and Conditions is the one available on the Website at the time of your order.

Section 2. Order

To place an order, you must be of legal age or an emancipated minor.

 To place an order on the Website, select the item you want, choose the size and quantity, and then click the "Add to Cart" button.

 Before placing an order, you must first review the Terms and Conditions. Then click the "Place Order" button.

 In accordance with Article L122-1 of the Consumer Code, ANAIS C. may refuse to fulfill an order for any legitimate reason, particularly if there is a dispute regarding payment for a previous order.

Once the order has been confirmed and paid for, you will receive an email confirming payment and acknowledging receipt of the order, which also serves as confirmation of the order. The order is then considered complete.

Once your order has been confirmed in this way, you will no longer be able to modify it on the Website. To check the status of your order, you can send an email at any time to the following address: contact@anaisc.com.

 

Article 3. Price

The prices listed on the Site are in euros and include all taxes but exclude shipping costs.

ANAIS C. reserves the right to change the prices of items at any time. The prices applicable to each order are therefore those listed on the Website at the time the order is placed.

The shipping costs for the items are listed in Section 6. The total amount you will be charged will be shown on the "Confirmation" page, which summarizes your order.

 

Article 4. Terms of Payment

4.1 Terms and Conditions

Payment is made directly online by entering the required information on the relevant page of the Website, via:

– credit card (CB, Visa, or Mastercard),

– PayPal.

 ANAIS C. reserves the right to suspend or cancel the order in the following cases:

– the issuer of your credit card refuses to authorize the payment for any reason,

– payment for the order is incomplete, incorrect, or missing for any other reason. 

Please note that any fees charged by the card issuer or your bank in connection with the payment transaction are your responsibility.

4.2. Payment Security

Payment for purchases is made through the secure platform. The customer expressly acknowledges that providing their credit card number to ANAIS C. constitutes authorization to charge their account for the full amount of the products ordered. If applicable, ANAIS C. will send the customer a notification of order cancellation due to non-payment to the email address provided by the customer when registering on the website.

The data recorded and stored by ANAIS C. serves as proof of the order and all sales made. The data recorded by the payment platform serves as proof of any financial transaction between the customer and ANAIS C.

For deliveries outside the European Union, the customer must pay any customs duties or other taxes due upon importation of the products into the country of delivery. The customer is also solely responsible for all related formalities. 

The Customer is solely responsible for verifying the importability of the ordered products in accordance with the laws of the country of delivery.

4.3. Invoice

All invoices will be available to view, download, and print in the "My Account/My Orders" section as soon as your order is shipped. If your order is shipped in multiple shipments, you will have as many invoices as there are shipments.

 

Article 5. Product Availability

Items are offered for sale while supplies last. You will be notified of the availability of the desired item before placing an order.

ANAIS C. undertakes to keep the availability status of all items offered on the Website up to date.

If, after you receive the payment confirmation and order confirmation email, it turns out that the item you ordered is no longer available, ANAIS C. will notify you by email as soon as possible, in accordance with Article L121-20-3 of the French Consumer Code.

In accordance with Article L121-20-3 of the Consumer Code, if the item you ordered is unavailable, you are entitled to:

– a refund for your order within a maximum of fourteen (14) calendar days, or

– the delivery of another similar product of equivalent quality and price.

 

Article 6. Delivery

In accordance with the provisions of Article L 121-20-3 of the French Consumer Code, the Products ordered will be delivered within the timeframes indicated on the website and in the order confirmation, and within 30 business days from the date of the order. The delivery times indicated on the website and at the time of order confirmation are provided for informational purposes only and correspond to the average time required for processing and shipping the package.

 

If the package is damaged upon delivery, the customer must check the condition of the products in their order in the presence of the carrier and clearly note any reservations regarding missing or damaged items on the carrier’s delivery slip. 

Products are shipped worldwide. We cannot ship to hotel addresses or P.O. boxes.

6.1. Delivery Times

Shipping within France:

– 5 to 8 business days via insured parcel, secure postal service.

– 2 to 5 business days via Colissimo for France.

Shipping within Europe and internationally:

– 1 to 5 days via a secure carrier (DHL).

Please note that any change to the delivery address made by the Customer after the order has been placed may result in a longer delivery time.

Since ANAIS C. and the carriers are separate and independent entities, ANAIS C. cannot be held liable for any delays, delivery errors, or lost packages attributable to Colissimo or the carrier.

6.2. Customs Duties and Taxes

Customs duties, local taxes, import duties, or state taxes may be applicable depending on the country of delivery. These fees and taxes are not charged by ANAÏS C. and are not its responsibility; they depend on the recipient’s customs status and are entirely the customer’s responsibility.

6.3. Delivery Complaints

Any failure to deliver or delay exceeding eight (8) business days must be reported to Customer Service as soon as possible at contact@anaisc.com. ANAÏS C. will not be able to process any claims submitted more than fifteen (15) calendar days after the order confirmation date.

The customer is required to carefully inspect the goods upon receipt. In the event of any issues (open package, damaged goods, wrong product), the customer must note this on the delivery slip and contact Customer Service by email or phone as soon as possible. 

If the products received do not match the order or if the customer is not fully satisfied with their purchase, they may exchange or return the items in accordance with the terms set forth in the “Returns/Exchanges” section of these Terms and Conditions.

 

Article 7. Statutory Warranties

You are entitled to statutory warranties, including the warranty of conformity under the terms set forth in Articles L211-4 through L211-14 of the Consumer Code, and the warranty against defects in the item sold under the terms set forth in Articles 1641 through 1648 of the Civil Code.

In accordance with Articles L121-21 et seq. of the French Consumer Code, you have a fourteen (14)-day right of withdrawal starting from the date of delivery of the items ordered. If you exercise this right of withdrawal, you will be fully refunded for the amounts paid for the items returned and accepted by customer service. You are responsible for the return shipping costs.

Before returning any items, you must notify us of your intention to cancel the order at the following email address: contact@anaisc.com

You will then need to return the items to the following address:

– in their original packaging,

– without having been worn, in a condition suitable for sale as new,

– along with the delivery slip received with the order.

The refund will be issued within seven (7) calendar days of ANAIS C.'s receipt of the returned items and after the return(s) have been accepted.

Article 8. Custom-made, semi-custom, alterations, and resizing

8.0. Definitions

For the purposes of these terms and conditions, the following terms refer to the services defined below. These terms and conditions apply to all of these services.

Custom jewelry: any piece created entirely according to the customer’s personal specifications, without using a pre-existing design.

Custom-made jewelry: any piece based on an existing design from the ANAÏS C. collection, personalized according to the customer’s preferences (choice of stone, cut, metal, or design variation).

Alteration: any work performed on a piece of jewelry belonging to the customer with the aim of changing its shape, reusing its materials, or repositioning its stones.

Resizing: any technical procedure performed to adjust the size of an existing ring or bracelet.

 

8.1. Deposit and Confirmation

All orders are confirmed upon the customer’s written acceptance of the quote and payment of a deposit equal to 50% of the total amount. Work may not begin until this initial payment has been received. The remaining 50% is due upon delivery or prior to shipment.

Quotes are valid for 7 days from the date of issuance, due to fluctuations in the price of gold.

8.2. No Cancellation, No Refund

Once the quote has been confirmed and the first payment has been received, the order cannot be canceled. The deposit paid is strictly non-refundable and non-exchangeable.

In accordance with Article L121-20-2 of the French Consumer Code, the 14-day right of withdrawal does not apply to jewelry made to the customer’s personal specifications. This provision applies to all services referred to in Article 8.0. Any service provided is non-refundable, non-returnable, non-exchangeable, and non-modifiable.

8.3. Changes currently being implemented

The order includes one or two rounds of email feedback, depending on the complexity of the project. A surcharge will apply for any additional rounds of feedback beyond the third. Any changes requested by the client during the project will be billed to the client.

8.4. Materials provided by the customer

In the event of a remodeling or resizing project involving gemstones and/or gold provided by the customer, these materials are not insured by ANAÏS C. Anaïs Cartier shall not be held liable for any theft, loss, or damage occurring during the manufacturing or shipping process. The customer is advised to have their own materials appraised and insured prior to shipment.

8.5. Completion Deadlines

The average turnaround time is 8 weeks from receipt of the deposit. This timeframe is approximate and may vary depending on the complexity of the project.

8.6. Pruning

Resizing is possible depending on the technical feasibility for each type of jewelry. This service is available.

 

Article 9. Intellectual Property

The Website is owned by ANAIS C., who holds the intellectual property rights thereto.

The Website and the data comprising the Website and its content, regardless of their nature (text, photographs, images, sounds, graphic elements, etc.), may be protected by intellectual property rights.

It is hereby noted that all distinctive signs, including trademarks and logos, are and remain the property of ANAIS C. or the respective intellectual property rights holders. In recognition of these exclusive rights to such signs, users of the Site are prohibited from using them for any purpose other than viewing the Site.

Any use of the Site or any or all of its components, other than for the purpose of viewing the Site, is prohibited without the express, prior written consent of the relevant rights holders.

 

Article 10. Data Confidentiality

We need your personal data to open your account, process and track your order, and, if applicable, send you promotional offers by email after obtaining your express prior consent.

In accordance with the French Data Protection Act of January 6, 1978, you have the right to access, correct, and object to the processing of your personal data. To exercise these rights, you may (i) either modify the information directly by logging into the account you have created, or (ii) submit a request, providing proof of your identity, by sending an email to the following address: contact@anaisc.com.

 

Article 11. Liability

Given the technical and telecommunications constraints associated with the use of the Site, ANAIS C. shall not be held liable for any damage caused by a malfunction—for which it is not responsible—in one or more of the steps involved in accessing the Site, the ordering process, payment, or delivery tracking, due in particular to the inherent risks associated with using the Internet, such as service interruptions, external intrusions, or the presence of computer viruses.

Furthermore, ANAIS C. shall not be held liable in the event that the non-performance or improper performance of its obligations is attributable either to your own conduct, to an unforeseeable and insurmountable act by a third party to the contract, or to a force majeure event.

 

Article 12. Entire Agreement and Validity of the Terms and Conditions

The Terms and Conditions and your order confirmation together constitute a single contractual agreement that sets forth the entire agreement between the parties.

If any provision of these Terms and Conditions is found to be invalid in whole or in part, the remaining provisions shall nevertheless remain in full force and effect. If necessary, the invalid provision shall be renegotiated in good faith.

 

Article 13. Governing Law and Dispute Resolution

These Terms and Conditions are governed by French law.

 In the event of a dispute regarding the interpretation or enforcement of these Terms and Conditions, the French courts shall have exclusive jurisdiction.
