GENERAL TERMS AND CONDITIONS OF SALE
These general terms and conditions (hereinafter referred to as the "General Terms") apply between ANAIS C. company and any consumer (hereinafter referred to as "you") placing an order on the website www.anaisc.com (hereinafter referred to as the "Site").
Sales on this Site are exclusively for consumers purchasing items for their personal use, strictly excluding any resale.
The General Terms may be amended at any time. The version of the General Terms applicable to your order is the one available on the Site at the time of purchase.

Article 2. Ordering
To place an order, you must be of legal age or an emancipated minor.
To place your order on the Site, you must select your chosen item, size, and quantity, then click the "Add to Cart" button.
Before placing any order, you must first review the General Terms. You then click the "Order Now" button.
In accordance with Article L122-1 of the Consumer Code, ANAIS C. reserves the right to refuse to fulfill an order for any legitimate reason, particularly if there is an outstanding dispute concerning the payment of a previous order.
Once your order has been validated and payment processed, you will receive electronic confirmation of payment acceptance and an acknowledgment of receipt, which serves as your order confirmation. The order is then considered complete.
Once your order is confirmed, you will no longer be able to modify it on the Site. To inquire about the processing status of your order, you may send an email at any time to: contact@anaisc.com.
Article 3. Pricing
The prices displayed on the Site are in euros, inclusive of all taxes, and exclude delivery charges.
ANAIS C. reserves the right to adjust item prices at any time. Consequently, the prices applicable to each order are those displayed on the Site at the time of purchase.
The delivery fees for items are detailed in Article 6. The breakdown of the total amount you will be charged will be displayed on the « Confirmation » page, which summarizes your order.
Article 4. Payment Terms
4.1 Methods
Payment is made directly online by providing the requested information on the relevant page of the Website, using:
– Credit card (CB, Visa, or Mastercard),
– Paypal.
ANAIS C. reserves the right to suspend or cancel an order in the following cases:
– Your credit card issuer refuses to authorize payment for any reason whatsoever,
– The order payment is incomplete, irregular, or non-existent for any other reason.
Please note that any fees that may be charged by your card issuer or your bank during the payment transaction remain your sole responsibility.
4.2. Payment Security
Payments for purchases are processed via the secure platform. The customer expressly acknowledges that providing their credit card number to ANAIS C. constitutes authorization to debit their account for the price of the ordered products. If applicable, a cancellation notification for non-payment will be sent to the customer by ANAIS C. to the email address provided by the customer during registration on the website.
The data recorded and stored by ANAIS C. serves as proof of the order and all past sales. The data recorded by the payment platform serves as proof of any financial transaction between the customer and ANAIS C.
For deliveries outside the European Union, the customer will be responsible for paying customs duties or other taxes incurred upon importing the products into the country of delivery. The related formalities are also the sole responsibility of the Customer.
The Customer is solely responsible for verifying the import possibilities of the ordered products in accordance with the regulations of the country of delivery.
4.3. Invoice
Every invoice will be available, downloadable, and printable in the « my account/my orders » section as soon as your order is shipped. If the order is shipped in multiple parts, you will receive a separate invoice for each shipment.
Article 5. Product Availability
Items are offered for sale subject to availability. You will be informed of the availability status of your desired item before placing any order.
ANAIS C. commits to keeping the availability status of all offered items updated on the Website.
If, after receiving the payment validation and order confirmation email, it appears that the desired item is no longer available, ANAIS C. will inform you by email as soon as possible, in accordance with Article L121-20-3 of the Consumer Code.
In accordance with Article L121-20-3 of the Consumer Code, in the event of unavailability of the ordered item, you will be entitled to:
– A refund for your order within a maximum of fourteen (14) calendar days, or
– The delivery of another similar product of equivalent quality and price.
Article 6. Delivery
In accordance with Article L 121-20-3 of the Consumer Code, ordered Products are delivered within the timeframes specified on the website and in the order confirmation, and within 30 business days from the date of order. The delivery times provided on the website and in the order confirmation are indicative only, representing the average processing and shipping duration for the package.
Should the package arrive damaged upon delivery, the client must inspect the condition of the ordered products in the presence of the carrier and clearly note any reservations regarding missing or damaged items on the carrier's delivery slip.
Products are shipped worldwide. However, deliveries cannot be made to hotel addresses or PO boxes.
6.1. Delivery Times
Delivery in France:
– 5 to 8 business days via declared value parcel, a secure postal service.
– 2 to 5 business days via Colissimo for France.
Delivery in Europe & Internationally:
– 1 to 5 days via secure carrier (DHL).
Please note that any change to the delivery address made by the Client after the order has been registered may result in an extended delivery timeframe.
As ANAIS C. and the carriers are distinct and independent entities, ANAIS C. cannot be held responsible for any delivery delays, errors, or package loss attributable to Colissimo or the designated carrier.
6.2. Customs Duties and Taxes
Customs duties, local taxes, import duties, or state taxes may be applicable depending on the country of delivery. These charges and taxes are not billed by ANAÏS C. and are not its responsibility; they depend on the recipient's customs regulations and are entirely borne by the client.
6.3. Delivery Complaints
Any delivery failure or delay exceeding eight (8) business days must be reported to Customer Service as soon as possible at contact@anaisc.com. ANAÏS C. will not be able to process any claim submitted more than fifteen (15) calendar days after the order confirmation date.
The client is required to carefully inspect the goods immediately upon receipt. In the event of any discrepancy (such as an open package, damaged goods, or incorrect product), the client must note this on the delivery slip and contact Customer Service by email or telephone as soon as possible.
If the products received do not match the order or if the client is not entirely satisfied with their purchase, they may proceed with an exchange or return according to the conditions stipulated in the 'Returns / Exchanges' section of these General Terms and Conditions of Sale.
Article 7. Legal Warranties
You benefit from legal warranties, specifically the warranty of conformity under the conditions set out in Articles L211-4 to L211-14 of the Consumer Code, and the warranty against hidden defects under the conditions set out in Articles 1641 to 1648 of the Civil Code.
In accordance with Articles L121-21 and subsequent articles of the Consumer Code, you have a right of withdrawal of fourteen (14) days from the date of delivery of the ordered items. Should you exercise this right of withdrawal, you will be fully reimbursed for the amounts paid corresponding to the items returned and accepted by customer service. Return shipping costs will be at your expense.

– in their original packaging,
– unworn, and in a condition suitable for resale as new,
– accompanied by the delivery note received with the order.
Refunds will be processed within seven (7) calendar days following ANAIS C.'s receipt of the returned items and after acceptance of the return(s).
Article 8. Bespoke, Semi-Bespoke, Transformation & Resizing Orders
8.0. Definitions
Within the context of these terms and conditions, the following terms refer to the services defined below. These conditions apply to all such services.
Bespoke Jewelry: Any piece created entirely according to the client's personal specifications, without a pre-existing model.
Semi-Bespoke Jewelry: Any piece derived from an existing ANAÏS C. collection model, customized according to the client's preferences (choice of stone, size, metal, or design variation).
Transformation: Any alteration made to a piece of jewelry belonging to the client, with the aim of changing its shape, reusing its materials, or repositioning its stones.
Resizing: Any technical adjustment made to adapt the size of an existing ring or bracelet.
8.1. Deposit and Confirmation
All orders are confirmed by the client's written acceptance of the quote and the payment of a 50% deposit of the total amount. Production can only commence upon receipt of this initial payment. The remaining 50% balance is due upon receipt or prior to shipment.
Quotes are valid for 7 days from their issue date, due to fluctuations in gold prices.
8.2. Non-Cancellation and Non-Refund Policy
Following the confirmation of the quote and receipt of the initial payment, orders cannot be cancelled. The deposit paid is strictly non-refundable and non-exchangeable.
In accordance with Article L121-20-2 of the Consumer Code, the fourteen-day right of withdrawal does not apply to jewelry manufactured according to the client's personal specifications. This provision extends to all services mentioned in Article 8.0. Any service rendered is non-refundable, non-returnable, non-exchangeable, and non-modifiable.
8.3. Modifications During Production
The order includes one to two rounds of feedback via email, depending on the project's complexity. A surcharge will be applied from the third round of feedback onwards. Any modifications requested by the client during the production process will be billed accordingly.
8.4. Materials Provided by the Client
For transformation or resizing services involving precious stones and/or gold provided by the client, these materials are not insured by ANAÏS C. Anaïs Cartier cannot be held responsible for theft, loss, or damage occurring during crafting or shipping. Clients are advised to have their own materials appraised and insured prior to sending them.
8.5. Production Timelines
The average production time is 8 weeks from the date the deposit is received. This timeframe is indicative and may vary depending on the project's complexity.
8.6. Resizing
Resizing is possible depending on the technical feasibility specific to each type of jewelry. This service is complimentary.
Article 9. Intellectual Property
The Website is the property of ANAIS C., who holds the associated intellectual property rights.
The Website and the data comprising the Website and its content, regardless of their nature (text, photographs, images, sounds, graphic elements, etc.), may be protected under intellectual property law.
It is hereby stated that all distinctive signs, particularly trademarks and logos, are and remain the property of ANAIS C. or the respective intellectual property rights holders. By acknowledging these exclusive rights over these signs, all users of the Website are prohibited from using them for any purpose other than browsing the Website.
Any use of the Website or any part of its constituent elements, other than for browsing the Website, is prohibited without the express, written, and prior consent of the relevant rights holders.
Article 10. Data Confidentiality
Your personal data is necessary for us to open your account, manage your order and its tracking, and, where applicable, send you commercial offers electronically after your express and prior consent.
In accordance with the French Data Protection Act of January 6, 1978, you have the right to access, rectify, and object to the processing of your personal data. To exercise these rights, you may either (i) directly modify the information by logging into your created account, or (ii) submit a request, providing proof of your identity, by sending an email to the following address: contact@anaisc.com.
Article 11. Liability
Given the technical constraints of computer and telecommunications inherent in using the Website, ANAIS C. cannot be held liable for any damage caused by a malfunction not attributable to it, occurring at one or more stages of Website access, the ordering process, payment, or delivery tracking, particularly due to inconveniences inherent in using the Internet, such as service interruptions, external intrusions, or the presence of computer viruses.
Furthermore, ANAIS C. cannot be held liable if the non-performance or improper performance of its obligations is attributable either to your own conduct, to an unforeseeable and insurmountable act of a third party to the contract, or to a case of force majeure.
Article 12. Entirety and Validity of the General Terms and Conditions
The General Terms and Conditions and your order confirmation form a contractual whole, representing the entirety of the agreements made between the parties.
Should any provision of the General Terms and Conditions be declared null and void, in whole or in part, the remaining provisions shall nevertheless remain fully applicable. If necessary, the invalidated provision will be subject to good-faith renegotiation.
Article 13. Applicable Law and Dispute Resolution
The General Terms and Conditions are governed by French law.
In the event of a dispute concerning the interpretation or execution of the General Terms and Conditions, the French Courts shall have exclusive jurisdiction.
